Acceptable Use Policy

This Acceptable Use Policy ("Policy") sets out the rules for using PhoneFleets' physical device fleet infrastructure (the "Service"). It applies to every device, account, and API integration on the Service. Violating this Policy may result in suspension or termination of your account, as described in our Terms of Service.

Prohibited activities

You may not use the Service to:

  • Engage in any activity that is illegal under the laws applicable to you, to us, or to the jurisdiction where a device is physically hosted.
  • Distribute malware, ransomware, or any software designed to damage, disrupt, or gain unauthorized access to systems you do not own or have explicit permission to test.
  • Send unsolicited bulk communications (spam), or operate schemes designed to artificially inflate engagement, views, or ratings on third-party platforms.
  • Commit fraud, including payment fraud, account takeover, or the creation of fake accounts or identities intended to deceive another party.
  • Infringe on the intellectual property, privacy, or publicity rights of any third party.
  • Harass, threaten, or exploit any individual, including the generation or distribution of content that sexualizes or endangers minors.
  • Attempt to circumvent, disable, or interfere with security-related features of the Service, or probe, scan, or test the vulnerability of our infrastructure without our prior written authorization.
  • Resell, sublicense, or provide third-party access to your allocated devices outside the scope of your own subscription, without our prior written agreement.

Third-party platform rules

Because our devices give you real, unrestricted device control, you remain solely responsible for complying with the terms of service of any application, platform, or service you access or automate through a PhoneFleets device. We do not monitor the content of your sessions, but we will act on credible reports of Policy violations.

Fair use of shared infrastructure

While each device you provision is dedicated to your account, the networking and management plane underlying the Service is shared infrastructure. You may not use the Service in a way that degrades performance or availability for other customers, including sustained abnormal resource consumption inconsistent with normal device usage.

Reporting a violation

If you believe someone is using the Service in violation of this Policy, report it to hello@phonefleets.com or through our contact page. Please include a description of what you observed, any evidence you have, and your contact information. We investigate every report and aim to respond within 15 business days.

Monitoring and enforcement

We actively monitor for violations of this Policy and investigate credible reports. Depending on severity, we may warn the account holder, suspend or terminate access to affected devices, terminate the account, or report suspected criminal activity to the relevant authorities, with or without prior notice. Suspension or termination for a Policy violation does not entitle you to a refund, as described in our Terms of Service.

Fraud prevention and cooperation with authorities

We take fraud and abuse seriously and actively work to detect, prevent, and pursue it. In doing so:

  • We monitor for fraudulent activity — including payment fraud, account takeover, identity misuse, and coordinated abuse — and act on it, including by suspending or terminating accounts.
  • We cooperate with law enforcement and other competent authorities, and we may report suspected criminal activity to the police, prosecutors, or regulators on our own initiative.
  • We may preserve and disclose account, billing, device, and activity data when required by a valid legal request (such as a court order, subpoena, or lawful request from a competent authority), or where we believe in good faith that disclosure is necessary to prevent fraud, protect our rights or users, or comply with the law.
  • We reserve the right to pursue civil and criminal remedies against those who use the Service to commit fraud or other unlawful acts, and to seek recovery of any resulting losses and costs.
