Terms of Service

The Service

PhoneFleets provides remote access to real, physical Android devices hosted and maintained in our facilities — never emulated or virtualized. Devices are made available to you on a dedicated, per-device basis according to your subscription.

Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate account information and notify us promptly of any unauthorized use.

Billing, cancellation, and refunds

• Billing: Subscriptions are billed per device, monthly or annually as selected at checkout. Applicable prices, discounts, and any volume or annual pricing are those displayed on our website at the time of purchase.
• Cancellation: You may cancel your subscription at any time from your account dashboard, with no early-termination fees. Your devices remain active for the rest of your current billing period, and cancellation takes effect at the end of it.
• Refunds: All subscriptions are prepaid and non-refundable. Charges are non-refundable once a billing period has begun, and we do not offer refunds, credits, or returns for partial periods, unused time, or devices you stop using, except where a refund is required by mandatory law. Cancelling stops future billing; it does not refund time remaining in a period you have already paid for.
• Failed payments: If a payment fails, we will attempt to retry it and notify you. Your devices may be suspended if payment is not resolved within a reasonable grace period.

Acceptable use

Your use of the Service must comply with our Acceptable Use Policy. We may suspend or terminate accounts that violate it.

Service availability

We target 99.9% platform uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where practical. We are not liable for outages caused by factors outside our reasonable control.

Limitation of liability

To the maximum extent permitted by law, PhoneFleets is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including lost profits, loss of data, or business interruption. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Governing law

These Terms are governed by the laws of Spain. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts and tribunals of Santa Cruz de La Palma, Spain, with express waiver of any other jurisdiction that may correspond, except where mandatory consumer-protection law in your jurisdiction provides otherwise.

Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice before taking effect.
